This Cookie Policy governs the use of cookies and other tracking technologies on the digital platform MakinIt, operated by THE STYLE FACTORY S.R.L. as Data Controller under Regulation (EU) 2016/679 (GDPR) and Italian data protection law (Legislative Decree 196/2003 as amended by Legislative Decree 101/2018).
Cookies are small text files that the website sends to the User’s device during browsing and that are then transmitted back to the website on subsequent visits. Alongside cookies, the Platform may use other online identifiers (e.g. pixels, tags, scripts, heat mapping tools, fingerprinting) which allow the collection of information on how the service is used, also for statistics, security, profiling and marketing purposes.
2.1 Technical or “necessary” cookies
These are cookies and tools that are strictly necessary for the technical operation of the Platform and for providing the service requested (e.g. session management, authentication, security settings, load balancing, protection against bots). They may include in particular:
session and authentication cookies of the Platform;
cookies storing consent preferences;
security tools such as Cloudflare and Google reCAPTCHA.
The legal basis for these cookies is the performance of a contract or the legitimate interest of the Data Controller in the proper delivery and security of the service; no User consent is required, while the information obligation remains.
2.2 Analytics cookies and measurement tools
The Platform uses tools to analyse traffic and User behaviour, including thirdparty services such as Google Analytics 4 and Microsoft Clarity, as well as other internal AI reporting systems.
These tools collect usage data (e.g. pages visited, navigation events, time spent, IP address, device identifiers, mouse movements, clicks) for the purposes of performance measurement and service improvement.
When configured so as not to allow direct identification of the User or to minimise impact on data subjects’ rights, the legal basis may be the Data Controller’s legitimate interest, together with data minimisation and, where possible, anonymisation measures.
If the data collected are also used for profiling or marketing purposes or involve transfers to third countries without adequate safeguards, prior consent via the cookie banner is required, in line with the Italian Supervisory Authority’s cookie Guidelines.
2.3 Profiling and marketing cookies
The Platform, in particular for Premium subscriptions and advanced visibility and matching services, may use cookies and tracking tools aimed at:
customising profile visibility (e.g. Featured, Spotlight) and smart matching between Vendors and Buyers;
delivering targeted advertising on thirdparty channels (e.g. Google Ads, LinkedIn Insight Tag);
sending B2B commercial communications and analysing campaign performance.
Such tools may be provided by third parties including:
Google Ads, LinkedIn Insight Tag, HubSpot CRM for marketing and CRM;
other tracking tools linked to social or advertising platforms used by the Platform.
The legal basis for these processing activities is the express consent of the User, given through the banner and preference management panel; some communications in the B2B context may also rely on the Controller’s legitimate interest, without prejudice to the right to object and withdraw consent.
2.4 Tracking tools for user experience and external content
To improve user experience and enable interaction with external content and platforms, the Platform uses:
Google Tag Manager for centralised tag management;
external content display services such as Google Fonts, Font Awesome, and map or multimedia player widgets;
heatmapping and sessionrecording tools such as Microsoft Clarity.
These tools involve the transmission of data (e.g. IP address, browser and device information, interaction events) to the respective providers; the legal basis is generally consent for nontechnical tracking.
Many of the services listed above are provided by third parties, including nonEU entities (e.g. Google LLC, Microsoft Corporation). In such cases:
data collected via cookies and tracking tools may be transferred to the United States or other third countries;
transfers take place, where possible, on the basis of Standard Contractual Clauses, adequacy decisions or the EUUS Data Privacy Framework, where applicable;
the Data Controller implements privacy by design and by default and data minimisation measures in accordance with Articles 24, 25 and 32 GDPR and the Supervisory Authority’s cookie Guidelines.
The User has the right to be informed of the existence of appropriate safeguards under Article 46 GDPR and to obtain a copy by contacting the Controller at the addresses provided. Use of services such as Google Analytics without adequate transfer safeguards has been the subject of decisions by the Supervisory Authority; MakinIt undertakes to configure such tools in compliance with the Regulation and with the Authority’s decisions.
4.1 Cookie banner and User choices
On first access to the Platform, a cookie banner is displayed, informing the User of the use of cookies and tracking tools and allowing the User to:
accept all nontechnical cookies and tools;
refuse or limit the use of profiling/marketing cookies and thirdparty tools;
access a “Manage preferences” section to configure in detail which categories of cookies are allowed.
In line with the Supervisory Authority’s cookie Guidelines:
no nontechnical cookie or tracker is activated before the User has given consent through a clear affirmative action (e.g. clicking “Accept” or “Save preferences”);
merely closing the banner (e.g. clicking “X”) or scrolling the page does not constitute consent and leaves the default settings unchanged (technical cookies only).
4.2 Documentation and duration of consent
The User’s choices (acceptance, refusal, custom settings) are logged and documented via technical cookies or similar tools, in order to demonstrate compliance with GDPR requirements.
The banner may be shown again:
when the conditions of processing change significantly (e.g. new trackers or new purposes);
when it is not possible to verify whether a cookie is already stored on the device;
after at least 6 months from the last display, in line with the Guidelines.
The User may modify preferences at any time by accessing the “Cookie settings” link or equivalent, available in the footer or in the account settings.
In addition to the tools provided by the Platform, the User may configure their browser to block cookies or delete those already stored on the device. The procedures vary depending on the browser used; Users may refer to the browser’s “Help” section for uptodate instructions.
Full or partial disabling of cookies may impair or make less efficient certain features of the Platform.
As data subject, the User may exercise, also with regard to data collected through cookies and other tracking tools, the rights granted under the GDPR, including:
right of access, to know which data categories and trackers are used;
rectification of any data wrongly associated;
erasure of data, in the cases set out in Article 17 GDPR;
restriction of processing;
data portability for data processed on the basis of consent or contract;
objection to processing for direct marketing and profiling purposes;
withdrawal of consent at any time, without affecting the lawfulness of processing carried out before the withdrawal;
complaint to the Italian Supervisory Authority (Garante per la Protezione dei Dati Personali).
